The EEOC, or Equal Employment Opportunity Commission, is a government agency that is set up to help fight against discrimination in the workplace. Unfortunately, most of the case workers there fight to prove the employer right and don’t give you a true chance to respond to claims made by the employer.
The EEOC covers a broad number of cases, like age, sex and medical discrimination, so chances are if you feel you have been discriminated against, it will fall under one of their categories. Here is the thing with most states. Many times, you must file a claim with the EEOC first before you can ever file a lawsuit. Often, the EEOC will never get very far and dismiss your case. If it does go to a longer investigation, they will do their own research, get information from the employer only and make a determination without ever letting you respond to possible erroneous claims. This also takes over a year on average to just get to this point.
This is when you need to step in and take down the employer if they have done something wrong to you. While it may be hard, you need to get witnesses and employees on your side. This is what is the killer to almost all cases, is the current employees fear of being reprimanded. It is an unfair and unjust practice that the EEOC does, so get a lawyer if you are in this situation. Trust me, you will not regret it, as the EEOC will not look out for you.
